I acknowledge, agree and accept that:
1. The coaching services and/or products offered by Coach Parry PTY LTD (registration
number 2019/192392/07) (“Coach Parry”):
1.1. do not constitute, and are not intended to substitute, any medical advice,
diagnosis or treatment provided by a fitness and/or medical professional;
1.2. must not be used by a client/customer without receiving prior medical consultation and clearance; and
1.3. must not be undertaken in contravention of any advice provided by a fitness and/or medical professional.
2. Each client/customer of Coach Parry shall be required to provide Coach Parry
with a warranty that he/she has obtained medical clearance to commence use
of the coaching services and/or products prior to purchasing and/or making use
of the aforementioned services and/or products.
3. Coach Parry does not accept any responsibility for a client/customer’s failure to
obtain medical clearance prior to purchasing and/or making use of Coach
Parry’s coaching services and/or products, alternatively, a client/customer’s
failure to make full disclosure of any and all fitness and/or medical risks and/or
conditions associated with or of relevance to his/her participation in any kind of
physical activity and, in particular, his/her use of the coaching services and/or
products.
4. For the avoidance of doubt, any person making use of the coaching services
and/or products offered by Coach Parry does so entirely at his/her own risk.
5. In providing personalised or one-on-one coaching services and/or products,
Coach Parry:
5.1. provides a product and/or service that is confidential and intended solely
for the use of the individual client/customer contracted to Coach Parry;
5.2. does not assume any responsibility or liability for the suitability of that
service and/or product for any person other than the individual
client/customer contracted to Coach Parry; and
5.3. does not accept any liability for services and/or products provided and/or
recommended to a client/customer based on incomplete, inaccurate,
delayed, dishonest and/or erroneous information and/or feedback
provided to it by the individual client/customer.
6. For the avoidance of doubt, any person making use of the personalised or one-
on-one coaching services and/or products offered by Coach Parry does so
entirely at his/her own risk.
7. In providing generic and/or standardised coaching services and/or products,
Coach Parry:
7.1. does not assume any responsibility for the suitability of that service or products for any person; and
7.2. will not be responsible for any damages or loss sustained by any person
whatsoever including damages and loss associated with injury, illness,
disability, death or the like.
8. For the avoidance of doubt, any person making use of the generic and/or
standardized coaching services and/or products offered by Coach Parry does
so entirely at his/her own risk.
9. This disclaimer extends to Coach Parry, its directors, shareholders, members,
agents, partners, administrators, affiliates, associates, trustees, sponsors,
employees, staff, successors and assigns who shall not be liable for any direct,
indirect, special, incidental or consequential damages, injury or loss (including
damages or loss associated with injury, illness, disability, death or the like),
whether based in breach of contract, breach of warranty, delict (including
negligence and/or gross negligence), product liability or otherwise, whether
arising out of any act or omission, intentional or negligent, breach of contract or
any other cause whatsoever.
